- A Settlement has been reached that will resolve a lawsuit brought on behalf of persons who allege Uponor, Inc. and Uponor North America, Inc., Defendants or Uponor committed negligence and other legal violations in connection with a November 2022 Data Security Incident. Uponor denies these allegations, denies violations of any law, and denies all liability.
- Who is a Settlement Class Member?
- Settlement Class Member: All persons whose Personal Information was impacted or potentially compromised as a result of the Data Security Incident that occurred on or about November 5, 2022. Uponor estimates that there are 7,158 individuals in the Settlement Class.
- What are the benefits? The Settlement provides the following benefits:
- Compensation for Ordinary Losses and Lost Time. Settlement Class Member may elect to be reimbursed for documented out-of-pocket expenses incurred as a result of the Data Security Incident, including up to 4 hours of lost time at $25/hour (up to $100), up to a maximum of $500 per person upon submission of an Approved Claim and supporting third-party documentation.
- Compensation for Extraordinary Losses. Each Settlement Class Members who was the victim of actual documented identity theft may also elect to receive up to a maximum of $5,000 in compensation for proven monetary loss.
- Alternative Cash Payment. Alternatively, if a Settlement Class Member chooses not to seek reimbursement for “ordinary” or “extraordinary” losses (including any losses related to “lost time”), Settlement Class Members may seek a $25 cash payment.
- Credit Monitoring Services. Separate and apart from the relief offered above, Settlement Class Members may also elect to enroll in credit monitoring services. Settlement Class Members who enrolled in the credit monitoring previously offered by Uponor shall have the opportunity to receive one (1) year of additional credit monitoring through Kroll’s Complete Monitoring identity-monitoring services. Settlement Class Members who did not previously receive such credit monitoring shall have the ability to receive two (2) years of credit monitoring through Kroll’s Complete Monitoring identity-monitoring services.
